On November 20, FMCSA proposed changes to the rule that lets a carrier review the broker's record of a load.

Carriers already have a right to look at the record of a load they hauled. A lot of broker contracts waive that right. The November 20 proposal would make the duty harder to waive. Comments are due January 21. It is a proposal, not a final rule.

Know what you already promised

You should be able to show the rate, the accessorials, and who pays detention without a fight. That is the confirmation the carrier signed. The argument about the shipper's sell rate is a different question, and it is not settled.

If you broker freight, do not be surprised when a driver asks for the record after the load. If you haul freight, ask what the confirmation covers before you roll, not after the POD is in.
